TERMS AND CONDITIONS

Drivepass UK driving school

You should read these terms and conditions carefully as they set out our and your legal rights in relation to the drivepass UK Driving School Website/App.

Our Website/App enables you to book driving tuition service with us or third party instructors/ driving schools

Any driving tuition services booked through our Website/App will be provided by udrive driving instructor unless stated otherwise and all agreements must be complied by our terms of agreement between the pupil and the driving instructor.

We may change these terms from time to time by publishing modified terms on this Website. If this happens, any changes will take effect straight away.

Your attention is specifically brought to the following important terms:

. For your rights to change or cancel a booking, please see cancellations, ( you will need to notify us of changes or cancellations at least 48 hours before the lesson starts);

 

Nothing in this agreement will affect any statutory rights you may have as a consumer.

 

1. Your agreement for driving tuition is with your instructor. The contract for driving tuition is solely between you and your driving instructor and is separate to this Agreement. Your driving instructor is responsible for any obligations relating to the provision of driving tuition (including for bookings made using our Website/App).

 

1.2 Acceptance of this Agreement.

By using the Website/App Services, you agree to be bound by this Agreement to the exclusion of all other terms and conditions. You also acknowledge and agree that we may process your personal data in accordance with our Privacy Policy and Cookie Policy (which are subject to change from time to time). If you do not accept the terms of the Agreement, please do not use our Website/App/

 

2. We act as agent for your instructor.

2.1 Your instructor. Your instructor and you are responsible for all services agreement at the time of bookings and lessons, we are not responsible for any dispute or financial loss you may have with your instructor. You are responsible for all matters relating to you booking and services.

3. enable you to bookings for driving tuition with your instructor:

3.1 supply any information or documentation to you; and/or

3.2. process any payments for your lessons.

3.3. Responsibility for matters relating to lessons and tests. In running their own business, your instructor is solely responsible for all matters relating to the provision of driving tuition under their separate contract with you. This means that you and your instructor will need to agree all matters relating to timing, location and content of driving lessons and tests.

4. Eligibility for booking lessons.

Lessons can only be booked using our Website/App for an individual who meets ALL of the following criteria;


Driving licence and eyesight-   You must hold a current and valid provisional licence which must be produced on the first lesson. You must also be able to read a number plate from a distance of 20.5 metres (67 feet) using your glasses if normally worn. If not, then the lesson will not take place.


Payments: Lesson payments should be made at the beginning of each lesson. Where an intensive, semi intensive course or block booking is arranged then the payment will be taken in full before the applicable arrangement. Payments are made direct to the instructor. We do not accept any responsibility whatsoever for any acts, default or failure on the part of the instructor to carry their obligations as regards payment. Udrive driving school cannot accept any responsibility for any payments of cash made, or cheques made payable, to the instructor. All lessons and courses are non-refundable once the lesson has commenced.

Intensive "Crash" Driving Courses: Any intensive or crash driving course booked the pupil must complete the course as agreed unless a valid reason can be provided otherwise the course will be cancelled. Where the intensive driving course includes any number of driving tests which is part of course booking, the pupil will not need to pay to book their driving test until such time the pupil(s) has used up all of their test booking allocations, then they must pay for any further lessons and any test fee. The test bookings will be managed by the instructor unless they change or cancel the course. The pupil has a duty to the meet the instructor at the date/time of their booking failure to do so will result in loss of lesson hours and charges applied. If the pupil is unable to keep their booking they must give 48 hour notice or show a valid reason and provide evidence when requested. You must agree and pay a non refundable deposit when making a booking this payment is then deducted from the total amount to be paid. If you cancel once a deposit has been paid you will not get a refund To cancel a lesson or course dates the pupil must give 48 hour notice. The pupil can cancel the course at anytime by giving notice to the instructor.. The instructor can cancel or terminate the course early by giving the pupil 48 hour notice due to any dispute or conflict with the pupil and receive a refund for any outstanding balance lesson admin fees and charges. All pupils must pay the course in full at the beginning of the lesson to the instructor. Udrive driving school takes no responsibility for any loss or dispute with instructor.

Deposit: any deposit paid to Drive Pass UK Driving School/drivepass uk or the instructor is non refundable. 

Course cancellation: If the pupil cancels a driving course without complete the course and would like a refund, there is a early cancellation charge as much as 50% of the total value of the course paid this also applies to block booking and block lessons.


Special Offers & Discount: When you book block of lessons in advance or take out special offers, or weekly courses, these lessons once commenced are non-refundable it’s your responsibility to complete the lessons non-compliance will result in loss of lesson hours and payment. We will not take any responsibility for any financial loss incurred by the pupil. This includes any discounted lessons or block bookings. We can withdraw or cancel any special offers or change any block bookings or change the lesson price at any time without further notice.


Cancellation: You need to give a minimum of 48 hours’ notice should you need to cancel or change the lesson. Otherwise the instructor will be within their right to charge for the pre booked lessons. It is recognised that in some cases a period of 48 hours is not possible in which case the charging for the lesson is down to the instructor’s discretion. The instructor reserves the right to cancel and reschedule a lesson if the weather or vehicle or instructor health issue or access at the time is down could cause danger. From time to time the instructor may inform you of a change in the lesson time or day or give priority for a driving test, or cancel the lesson, the instructor cannot be held responsible for these actions.


Driving Tests: can be booked by you after consultation with you instructor. Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed to allow for someone else’s driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately. Test appointments must be notified to your instructor as soon as they are known: otherwise he or she cannot guarantee to provide a vehicle for the test. In the interests of customer and public safety your instructor reserves the right to withhold the use of a car for the test if, in their opinion, you’re driving is not to high standard or potentially dangerous. In addition, the instructor reserves the right to withhold the use of the tuition vehicle for the purposes of taking the practical driving test if, in the opinion of the instructor, it is considered that the pupil is unfit to drive due to any reason, including but not limited to: being under the influence of alcohol or drugs, illness, injury, failing to wear glasses or contact lenses where these are required by law, wearing footwear or other clothing that would make driving hazardous. In these instances, the instructor reserves the right to charge the Pupil must also take note of any medication they are taking that may affect their ability to drive safely and advise the Instructor accordingly before taking any lesson booked. 
Punctuation: Lessons will start at the pre booked time, if you the pupil do not meet the instructor at the appointment time the instructor will wait for period of 10 minutes after the time agreed. You the pupil must make every effort to contact the instructor if you are going to be delayed. Once the instructor is satisfied that you are not going to meet at the booking time and after the waiting period of 10 minutes has lapsed the instructor can cancel the lesson and charge you for the cancellation. The instructor can take photo and video evidence to proof the instructor had waited for the pupil at the given time. If the instructor is delayed in anyway the instructor will try to make a concerted effort to inform the pupil of their estimated time of arrival, from time to time the instructor can be delayed due to events which they have no control over the instructor cannot be held responsible, the instructor will try to make up the loss of the time on that lesson or another lesson so you do not lose your lesson hour.  This will be done at the instructors own discretion. However if pupil meets the instructor after the pre-booked time because of their negligence then the instructor will add that time wasted in the lesson and will not be held responsible for this action taken
Liable:  you the (pupil) or a third party who books driving lessons on behalf of the pupil are undertaking responsibility and accept and agree to the terms and conditions. No contractual liability shall arise or subsist between the Pupil and drivepass. By agreeing to take driving lessons from the aforementioned driving school, it is accepted that you have read and agreed to our terms and conditions.                                                                                                                                                                                                                                                                                                                                                  
Zero codes of Tolerance: Drivepass UK Driving School with accordance with DSA (Driving Standards Agency) will not tolerate any form of abuse to any of our instructors. If this takes place at any time the instructor will terminate the lesson and the pupil will asked to leave the vehicle without notice. The pupil will be charged for the lesson at the full daily rate. The instructor and drivepass driving school will not be held responsible for any financial losses incurred or otherwise by you.
Driving Test: There is an additional charge if the pupil wishes to use the instructor’s car for the purpose of the driving test. The additional charge covers the liability insurance, while the vehicle is being used for the driving test.

 

 

Covid 19: To keep all pupils safe during this difficult time we need pupils to follow some simple rules when taking driving lessons.

All pupils must wear a face covering when taking any lessons. We ask pupils to sanitize their hands prior getting into the car.

Pupils who do not feel well have a temperature or a new cough or test positive for covid 19 must inform us immediately prior their lesson taking place and follow self isolation guidelines. Their lesson will be cancelled and rearranged a later date.

The instructor will wear a face covering during the lesson.
